End User License Agreement

By downloading, installing, or using the 404 desktop application, you agree to this End User License Agreement ("Agreement"). If you do not agree, do not install or use the software.

This Agreement governs your licensed use of the proprietary portions of the 404 desktop application. It does not replace or limit any rights you may have under licenses that apply to separate open source components included with the software.

Important: 404 includes the open source STATIC proxy component, which is licensed separately under the GNU Affero General Public License v3 (AGPLv3). That component is not governed by this Agreement.

Grant of License

Subject to your compliance with this Agreement and maintenance of an active subscription where required, 404 grants you a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to install and use the 404 desktop application on devices you own or control.

This license extends to updates and new versions of the application delivered through the automatic update mechanism.

This license is granted solely for your own use. You may not use 404 on behalf of third parties or as part of a commercial service offering unless 404 has expressly authorized that use in writing.

Restrictions

You may not:

  • Copy, modify, or distribute the 404 desktop application or any proprietary component of it.
  • Reverse engineer, decompile, or disassemble any proprietary component of the application, except where applicable law expressly permits that activity despite this limitation.
  • Rent, lease, lend, sell, assign, or sublicense the application or your subscription to any third party.
  • Remove or alter any proprietary notices, labels, or marks on the application.
  • Use the application in any manner that violates applicable law or this Agreement.

Open Source Components

404 includes STATIC, an open source proxy component licensed under the GNU Affero General Public License v3 (AGPLv3). STATIC is not covered by this Agreement. Your use of STATIC is governed solely by the AGPLv3.

Nothing in this Agreement restricts any rights you may have under the AGPLv3 with respect to STATIC.

Intellectual Property

The 404 desktop application, excluding open source components and other separately licensed material, is proprietary software. All rights, title, and interest in and to the application, including all intellectual property rights, remain with 404.

This Agreement does not grant you any right to use 404 trademarks, trade names, logos, or other brand features except as necessary for ordinary permitted use of the software.

No Warranty

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 404 DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

404 does not warrant that the application will operate without interruption or error, that defects will be corrected, or that the application will meet your requirements.

404 is a privacy tool designed to reduce fingerprint-based tracking. It does not guarantee anonymity and does not protect against all forms of surveillance, tracking, or identification. You are solely responsible for evaluating whether 404 meets your security and privacy requirements before relying on it.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 404 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PRIVACY, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF 404 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL 404'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE AMOUNT PAID BY YOU TO 404 IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In those jurisdictions, 404's liability is limited to the maximum extent permitted by law.

Termination

This Agreement remains effective until terminated. Your rights under this Agreement terminate automatically if you fail to comply with its terms or if your subscription lapses where an active subscription is required for access.

Upon termination, you must stop using the application and delete all copies in your possession or control.

404 may terminate this Agreement for cause. Sections that by their nature should survive termination, including intellectual property, no warranty, limitation of liability, and governing law, will survive.

Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any legal action arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in El Paso County, Colorado.
